Biological Father Seeks Custody of 3-Year-Old Legally Adopted By Another Family

Tammy and Edward Dalsing of Rock Hill, S.C. are speaking out after a 3-year-old they legally adopted may end up being taken from them and given to her biological father.  It's the only family 3-year-old Braelynn has ever known.

The young girl has been in the care of the Dalsing's since she was three weeks old and was legally adopted in 2015 when her biological mother gave up her parental rights and her biological father's rights were terminated due to his incarceration. 

Now, the father wants her back and a judge is on his side, reversing the Dalsing's original adoption order.

At first, the judge was clear on why she chose the Dalsing's instead of her biological parents, but now the judge is rescinding that choice. The court said being incarcerated wasn't reason enough to terminate a parent's right.

"I was just stunned when we got the word from... when we got the word from the appellate court," Edward said. 

Now, the family has requested a re-hearing with the state court of appeals.  Braelynn has never met her biological father and has lived with the Dalsing's her entire life.

Her biological father's attorney released a statement to WBTV, saying, "Mr. Myers is very pleased with the outcome."  He continues to say that it is unfortunate a private matter has gone public and he believes this will haunt Braelynn for years and years to come. "It is extremely selfish and will never be in the best interest of any child."

For now, the Dalsing's plan to appeal and Braelynn will stay with them until a final decision is made.
